TERMS AND CONDITIONS

The following T’s & C’s apply to any purchase of the Breakthrough Mastermind with Lisa Corduff.
This Agreement is between us — Lisa Corduff and any authorised team members of Lisa Corduff (“us”, “we”, “Lisa Corduff”) — and you (“The Buyer”) about your purchase of the The Breakthrough Mastermind (“The Program”).

1. Agreement

a) By purchasing The Program you understand that you are assenting to these terms and conditions.

b) You acknowledge that you are purchasing a single license for this program for your personal, individual use only.

c) Lisa reserves the right to change or update this agreement at any time, and will inform you in writing via the email address you provided during the application process. You must inform us as soon as possible if your contact email changes or is no longer available, and we cannot be held liable for any missed communication or opportunities if this is not provided in a timely manner.

2. The Program

“The Program” includes all materials, content, text and miscellanea comprising and related to The Breakthrough Mastermind. This includes but is not limited to: the sales page for the program itself, the content of all lessons, all worksheets, videos, audios, downloads, interviews, the branding and design, the sales emails, the course emails, and all examples provided (except where otherwise specified).

What you get

• A monthly live group call with individual hot seats, to come with an individual question or concern, conducted via Zoom (Feb - Dec 2020)
• A private Facebook group facilitated by Lisa (Jan - Dec 2020)
• Fortnightly 'office hours' with support from Lisa and her team (Feb - Dec 2020)
• A monthly accountability check-in vai Facebook (Feb - Dec 2020)
• A monthly Brains Trust call with individual hot seats - led by participants (Feb - Dec 2020)
• Exclusive trainings and guest speakers
• Gold Coast retreat - 2 nights accommodation, meals and refreshments from Friday dinner to Sunday afternoon tea, trainings, activities and experiences. All other travel costs are the responsibility of the Buyer. Partial refunds are not available if the Buyer is unable to attend this event.
• Noosa retreat - 2 nights twin-share accommodation, meals and refreshments from Friday dinner to Sunday afternoon tea, trainings, activities and experiences. All other travel costs are the responsibility of the Buyer. Partial refunds are not available if the Buyer is unable to attend this event.
• Melbourne Weekender -  full catering for Saturday morning tea, lunch, afternoon tea and dinner, and full catering for Sunday morning tea, lunch and afternoon tea. All travel, accommodation and other meal costs are the responsibility of the Buyer. Partial refunds are not available if the Buyer is unable to attend this event.

The retreats are not compulsory, though highly recommended.

Lisa Corduff reserves the right to reschedule any of the aforementioned events or broadcasts, with as much notice as possible - which will be given via email and the Facebook group. It is your sole responsibility to ensure that you are available to attend, though every reasonable effort will be made to find a time that suits all participants. Further, it is your sole responsibility to ensure you have an active Facebook and Zoom account, and understand how to use them prior to the commencement of the mastermind (all reasonable efforts will be made to assist you).

3. Copying, Copyright, Unauthorised Distribution

a) Nothing in this program may be reproduced, redistributed, modified, published, transmitted, passed on, copied, used as teaching materials, or given to other people (clients, friends, colleagues or otherwise) without prior permission of the author.

b) Such permission must be explicit and in writing.

c) All the materials are for your personal use only and are not to be used in teaching, coaching, events, workshops, webinars, or elsewhere in your business except for the purpose in which they are intended.

d) All rights are reserved. Everything is the intellectual property of Lisa Corduff (except for photographs or where otherwise specified). And it’s all protected by law.

e) The terms and conditions regarding use of materials apply upon registration for the program, while you are taking the program, and upon and after completing, withdrawing from or terminating the program.

4. Refunds

Once you accept a place in The Breakthrough Mastermind and make the first payment, we do not offer refunds or cancellations.

Upon purchase you are making a commitment to the duration of The Program and your fellow participants. We’re sharing our best ideas, the insider stuff that’s working now, and the inner workings of our businesses. To ensure that this energy exchange is respected, refunds and cancellations are not available.

5. FINANCIAL OBLIGATION

You are responsible for the completion of all payment plans associated with the purchase of The Program. We reserve the right to seek recovery of any monies remaining unpaid via a Collection Agency.

6. METHODS OF PAYMENT

We accept Visa, Mastercard, and American Express as a form of payment. If you choose to pay by monthly installments, you authorise the monthly charge for the product on your credit card or debit card.

7. Membership Details

a) You are responsible for setting up your own password. Details as to how to do so will be sent to you in your Welcome email.

b) It is your responsibility to keep these login details safe and private.

c) Your access details may not be passed on to third parties. Passing your access details on to a third party means you will be in breach of this agreement.

d) If your email address or any other relevant details change, it is your responsibility to update those items in the membership portal.

8. Access and Technology

a) If there are any problems with the website or if the host/network should go down due to circumstances beyond our control, Lisa Corduff shall not be held responsible. We will do our best to get the system back up as soon as possible when it is within our control.

b) Lisa Corduff shall not be liable to you or any other party as a result of any viruses or malware that may infect your or any other party's electronic equipment.

c) You agree that you will not use any robot, spider or other device, process or means to access The Program.

d) You agree that you will not:
ii. compromise or circumvent the security controls of The Program or otherwise gain unauthorized access to The Program
iii. attempt to interfere with the proper working of The Program

9. Liability

a) To the extent not prohibited by law, Lisa Corduff shall not be liable for any consequential, incidental, special or other indirect damages, such as lost profits, arising from the program, course materials or any actions or failure to act of Lisa Corduff. In the event that Lisa Corduff shall fail in accordance with these terms, Lisa Corduff’s entire liability and the Buyer’s exclusive remedy for breach of these terms shall be to refund all payments actually received by Lisa Corduff from the Buyer for the program. In no event shall the aggregate liability for damages of Lisa Corduff arising from these terms whether by contract or tort exceed the amount/s the Buyer paid Lisa Corduff.

b) In addition to the above, the Buyer specifically agrees that Lisa Corduff DOES NOT:

i. Accept responsibility or liability for any loss suffered by the Buyer
ii. Assume responsibility or liability for the accuracy or completeness of content contained in the materials or links.
iii. Provide or arrange for any insurance for, or on behalf, of the Buyer
iv. Provide any indemnity for loss or injury suffered by the Buyer
v. Guarantee any results from this program, monetary or otherwise
vi. Guarantee continual access to the program, where such is outside of our control

10. Attestation

Lisa Corduff reserves the right to
a) Terminate access to any Buyer who does not abide by these terms and conditions.
b) Pursue legal actions where its rights have been willingly and unlawfully infringed.
c) Terminate access without notice to any Buyer whose payment is declined or in some way retracted or denied.

11. Financial Disclaimer

Individual results may vary. No guarantee is given as to specific results, financial or otherwise.

12. Privacy Policy

Lisa Corduff will not share your information with any third party without your consent, and it will only be used for administrative and notification purposes.

13. Lifetime of The Program

a) Lisa Corduff reserves the right to cease providing, hosting or offering this Program at any time.

b) Should Lisa Corduff decide to cease offering this Program, you will be notified via email and given the opportunity to access and download the materials (for you to keep for your personal use). It is your responsibility to do this. The materials will be kept online and available for a minimum of 30 days after the notification email has been sent.

c) If your email address has changed or you do not receive the email notifying you of this, Lisa Corduff will not be held responsible.

14. TERMINATION

Lisa Corduff is committed to providing all participants in The Program with a positive experience of The Program. By purchasing this product, you agree that we may, at our sole discretion, terminate this Agreement, and limit, suspend, or terminate your participation in the Program without refund or forgiveness of monthly payments if you become disruptive to Lisa Corduff or Participants, fail to follow the Program guidelines, are difficult to work with, impair the participation of the other Participants in the Program or upon violation of the terms as determined by Lisa Corduff. You will still be liable to pay the total contract amount.

14. Other Provisions

a) When we communicate with you we will generally do so by email. You agree that email communications are contractually binding in the same way as properly signed and dated documentation sent by post.

b) Nothing in this agreement or on our websites (including https://lisacorduff.com) shall confer on any third party any benefit or obligation.

c) If any of these terms is at any time held by any jurisdiction to be void, invalid or unenforceable, then it shall be treated as changed or reduced, only to the extent minimally necessary to bring it within the laws of that jurisdiction and to prevent it from being void and it shall be binding in that changed or reduced form. Subject to that, each provision shall be interpreted as severable and shall not in any way affect any other of these terms.

d) No waiver by us, in exercising any right, power or provision in this agreement shall operate as a waiver of any other right or of that same right at a future time; nor shall any delay in exercise of any power or right be interpreted as a waiver.

e) In the event of a dispute arising out of or in connection with these terms or any contract between you and us, then you agree to attempt to settle the dispute by engaging in good faith with us in a process of mediation before commencing arbitration or litigation.

f) We are not liable for any breach of our obligations resulting from causes beyond our reasonable control.

g) This Agreement shall be governed by and construed in accordance with the law of Victoria, Australia and all international governance is expressly excluded.

h) You are deemed to have accepted these terms and conditions when you proceed with your purchase.
